Confidentiality of all complaints, investigatory reports and information, exceptions

Records about people who apply for or hold a license to work with controlled substances are kept private. They can only be shared if the person agrees in writing, or with certain government or law enforcement agencies. But some basic information is public — like a person's name, address, whether they are registered, and any final discipline taken against them. Also, if an investigation is still going on, the person being investigated cannot see those records yet.

195.042. of all complaints, investigatory reports and , exceptions. — All complaints, investigatory reports, and information pertaining to any , or individual are confidential and shall only be disclosed upon written of the person whose records are involved or to other or law agencies acting within the scope of their . However, no applicant, registrant or individual shall have access to any complaints, investigatory reports or information concerning an investigation in progress until such time as the investigation has been completed. Information regarding identity, including names and addresses, , taken and currency of the registration of the persons possessing registrations to conduct activities involving and the names and addresses of the applicants shall not be confidential. This section shall not be to authorize the of records, reports or other information which may be held in files for any registrant or applicant which are subject to other specific state or federal laws concerning their disclosure.
