Occupational or business license for construction contractors, city or county
When a city or county gives a construction contractor a business license, it must first see proof that the contractor has workers' compensation insurance, or a signed paper saying the contractor does not need it. A contractor who does not provide this proof gets denied a license. Giving fake information to get the license is against the law. Cities and counties cannot be sued just because they issued a license under this rule.
287.061. for construction s, city or county — duty to require of , when, effect. — 1. Any city or county which issues an occupational or business license for a contractor in the construction industry shall require a for workers' compensation coverage or an , the form of which shall be developed by the , signed by the attesting that the contractor is . No city or county shall have the duty to investigate any certificate of insurance or affidavit filed this section.
2. Any contractor who fails to comply with the of 1 of this section shall be denied such a until he or she furnishes a certificate of insurance.
3. It is , pursuant to section 287.128, for any contractor to provide pursuant to this section.
4. Nothing in this section shall be to create or constitute a to or a against a city or county in regard to the of any license pursuant to this section.
