Cafeteria plan payroll deductions, not to reduce computation of employee compensation

If a job offers a 'cafeteria plan' (a benefits program where workers choose their own benefits and some pay comes out before taxes), the money taken out for that plan does not lower the amount used to figure out a worker's workers' compensation payment if they get hurt on the job.

Word-for-word law

287.252. s, not to reduce computation of employee . — Where an employer has established a cafeteria plan for the employees of the employer in accordance with Section 125 of 26 United States Code, no payroll deduction or other reduction in salary of any employee made for the purpose of participating in such cafeteria plan shall have the effect of reducing the compensation amount used in calculating the employee's compensation or wages for the purpose of any governed by this chapter.
