Division to make rules and regulations
The workers' compensation division can make rules to run the workers' comp system, and those rules need approval from a state commission. The division can throw out a case or rule against someone who ignores its orders. Old injury reports where no money was paid can be thrown away after 5 years, and records from cases where money was paid can be thrown away after 10 years from when payments ended. Important case records must be kept for at least 10 years.
287.650. to make — power to destroy reports, when — s. — 1. The shall have such powers as may be necessary to carry out all the of this chapter including the use of electronic processes, and it may make such rules and regulations as may be necessary for any such purpose, subject to the approval of the of Missouri. The division shall have power to strike and enter awards against any or parties who fail or refuse to comply with its lawful orders.
2. (1) The division shall have the power upon the expiration of five years after their receipt to destroy reports of injuries on which no ( of medical costs) was due or paid, together with the papers attendant to the of such reports, and also to destroy records in cases after the expiration of ten years from the date of the of compensation.
(2) Records in cases that are submitted for in the division shall include all documentary exhibits admitted as evidence at the hearing. Records in all other cases shall include all documents required to be filed with the division by this chapter or by rule of the division, medical reports or records which are relied upon by the or in approving the , and copies of the compromise lump sum settlement. These records shall be kept and stored by the division for a minimum of ten years and shall include the originals or duplicate originals stored by electronic or other means approved by the division.
3. No rule or portion of a rule under the of this section shall become effective unless it has been promulgated the provisions of section 536.024.
