Owner and operator leasing motor vehicle with driver to a for-hire common or contract carrier not deemed employed for unemployment compensation, exception
If someone owns a motor vehicle and drives it themselves under a lease or contract for a for-hire trucking company, that person is not counted as an employee for unemployment benefits. There is one exception — if the trucking company is a nonprofit organization or a government agency, then that person is counted as an employee.
