Power to subpoena records and witnesses

This law gives unemployment officials the power to call witnesses and demand records when looking into cases. Witnesses who are called in get paid for travel and their time. Even if someone thinks their answers might get them in trouble, they still have to show up and answer questions — but if they say they are worried about self-incrimination before answering, what they say cannot be used against them in court later. However, if someone lies while testifying, they can still be charged for that lie.

288.230. Power to records and witnesses — and for witnesses — witness's right against , procedure to , effect. — 1. In the of the duties imposed by this law, the , the , an , and any of any of them shall have power to , take , to official acts, and to the attendance of witnesses and the production of books, papers, correspondence, memoranda, and other records necessary as evidence in connection with a or any other phase of the of this law. Witnesses this shall be allowed mileage and per diem at a rate by the . Such fees shall be deemed a part of the expense of ing this law.

2. No person shall be excused from attending and testifying or from producing books, papers, correspondence, memoranda and other records before the director, the commission, an appeals tribunal, or any duly authorized representative of any of them on the ground that the or evidence, documentary or otherwise, required of him may tend to him or subject him to a or ; but no individual shall be or subjected to any penalty or forfeiture for or on account of any transaction, matter, or thing concerning which he is compelled, after having claimed his , to testify or produce evidence, documentary or otherwise, except that such individual so testifying shall not be from and punishment for committed in so testifying.
