Electronic document transmission and filing requirements

This law covers how Missouri's unemployment division can send and receive paperwork electronically. The division can send notices and decisions to employers and claimants by email or other electronic means instead of regular mail, unless someone asks for a different method. People can also file appeals and other papers through the division's website, and the division's computer records the exact time it was received. Computers can handle many tasks for the division, but if an employer formally challenges something or there is a fraud issue, a real person called a deputy must look into it and decide. Any appeal of a decision must also be heard and decided by a real person called an appeals referee, who must give everyone a fair chance to be heard.

288.247. Electronic document transmission and requirements — investigations of ed s and , s decided. — 1. Except as otherwise required by law, any notice, , decision, or other paper required to be mailed by the to an or under this chapter may be transmitted solely by to any employing unit or claimant, unless an alternative method of transmittal is requested by the employing unit or claimant. The date the division transmits such notice, determination, decision, or other paper shall be the date of mailing or notification.

2. Any protest, , or other paper required to be filed with the division under this chapter may be filed by electronic means to the website specified by the division. The date and time of receipt shall be determined by the division's computer system.

3. Any function required to be performed by a of the division under this chapter may be performed by the computer or other automated means programmed and tested by a representative of the division, office of , or a retained to perform such programming under the direction of the division or office of administration. However, any issue raised by an employer in a timely protest and any issue of fraud under section 288.380 shall be decided by a of the division after investigation. Further, any appeal to a determination issued by the division or deputy shall be decided by an or decision of an after an opportunity for a fair as provided in section 288.190.
