Death of owner and no surviving owner or beneficiary, director of revenue may transfer and issue new certificate, when, procedure to obtain
When a vehicle owner dies and there is no co-owner or named beneficiary on the title, the state can transfer the title to someone else. To do this, the person asking for the transfer must show proof of death, turn in the old title, fill out an application, and pay a fee. They also need to provide one of four things: a court order about the estate, a small estate affidavit stamped by the probate court, a signed statement from the spouse or minor children claiming the vehicle, or a signed application from the person in charge of the estate along with their legal paperwork.
301.682. Death of owner and no surviving owner or , may and new , when, procedure to obtain. — If an owner dies and no surviving owner or surviving beneficiary exists, on of death of all persons shown on the , surrender of the outstanding certificate of ownership, and on and payment of the fee for an original certificate of ownership, the director of revenue may rely on, transfer and issue a new certificate of ownership in accordance with one of the following:

(4) A for transfer from a of the deceased owner accompanied by a copy of the personal representative's letters of administration or together with a court order approving the transfer or a statement that the personal representative has under section 473.457 or (16) of section 473.810 to make the transfer without court order.
