Roadside checkpoints and roadblock patterns based on vehicle type prohibited
Police cannot set up a checkpoint that stops people just because of what kind of vehicle they drive. For example, they cannot pull over only motorcycles. However, police are still allowed to set up checkpoints that only check large commercial trucks. Other kinds of legal checkpoints are still allowed.
304.152. s and s based on vehicle type prohibited. — 1. any of the law to the contrary, no may establish a roadside checkpoint or roadblock pattern based upon a particular vehicle type, including the of motorcycle-only checkpoints.
2. Notwithstanding 1 of this section, a law enforcement agency may establish a roadside checkpoint pattern that only stops and checks commercial motor vehicles, as defined in section 301.010.
3. The of this section shall not be to restrict any other type of checkpoint or roadblock which is lawful and is established and operated in accordance with the provisions of the United States Constitution and the Constitution of Missouri.
