Entertainment district special licensee
This law is about a special alcohol license for certain entertainment districts in Missouri. A person can apply for this license to sell drinks from movable bars (like carts or kiosks) in a specific type of entertainment area near a large lake. The license costs $300 a year, allows drink sales most of the day and into the night, and lets people carry drinks between businesses and common areas inside the district — but not outside it. The district must make it easy to tell who is old enough to drink, and every business must serve drinks in cups that show their own name or logo.
311.084. Entertainment special — definitions — , fee, requirements. — 1. As used in this section, the following terms mean:
(1) "", any area as a common area in a development plan for an entertainment district approved by the of the county, city, town, or village; any area of a that is adjacent to or within the entertainment district and has crossings well marked; and any other area identified in the development plan or district plan;
(2) "Entertainment district", any area located in any county that borders on or that contains part of a lake with not less than one thousand miles of shoreline that:
(a) Is located in any city with more than one thousand nine hundred but fewer than two thousand one hundred fifty inhabitants and partially located in a county with more than twenty-two thousand but fewer than twenty-five thousand inhabitants and with a county seat with more than one hundred but fewer than five hundred inhabitants; and
(b) Contains a combination of entertainment venues, bars, nightclubs, and restaurants;
(3) "", any bar, table, kiosk, cart, or stand that is not a permanent fixture and can be moved from place to place.
2. any other of this chapter to the contrary, any person who possesses the qualifications required by this chapter, and who meets the requirements of and complies with the provisions of this chapter, may apply for, and the may , an entertainment district special to sell for for consumption from one or more portable bars within the entertainment district from 6:00 a.m. until 3:00 a.m. on the following day, Monday through Saturday, and from 6:00 a.m. until 1:30 a.m. the following day on Sunday.
3. An granted an entertainment district special license under this section shall pay a license fee of three hundred dollars per year.
4. Notwithstanding any other of this chapter to the contrary, the of the entertainment district special license, at its , shall determine when and where a licensee is allowed under this chapter to sell alcoholic beverages. Persons may be allowed to leave licensed establishments located in portions of the entertainment district with an alcoholic beverage and enter upon and consume the alcoholic beverage within other licensed establishments and common areas located in portions of the entertainment district. No person shall take any alcoholic beverage or alcoholic beverages outside the boundaries of the entertainment district. At times when a person is allowed to consume alcoholic beverages dispensed from portable bars and in common areas of all or any portion of the entertainment district, the entertainment district shall ensure that minors can be easily distinguished from persons of legal age buying alcoholic beverages.
5. Every licensee within the entertainment district shall serve alcoholic beverages in containers that display and contain the licensee's or logo or some other mark that is unique to that license and licensee.
6. The holder of an entertainment district special license is solely responsible for alcohol violations occurring at its portable bar and in any common area.
