Sale by drink defined

If someone sells alcohol (not beer or malt drinks) in a container smaller than 50 milliliters, that counts as selling it 'by the drink.' Only a person with a retail liquor dealer's license is allowed to do this. When they sell it that way, the small container must be opened and poured out, just like any other drink sold by the drink.

311.100. Sale by drink defined. — The sale of any except , in the , in any quantity less than fifty milliliters shall be "sale ", and may be made only by a of a and when so made, the container in every case shall be emptied and the contents thereof as other sold by the drink are served.
