Local option provisions applicable only to sales for consumption on premises

Local option voting rules only apply to places that sell drinks to be consumed right there on the spot. These rules do not stop stores from selling sealed, unopened bottles or packages of alcohol to take home. These rules also do not stop places from selling beer with 5% alcohol or less by the drink to be drunk on the spot, as long as they have the right license.

311.170. applicable only to sales for consumption on . — The provisions made by this chapter for local option shall be held to be applicable only to sales for where sold, and shall not be to prevent the sale of in the and not to be opened or consumed on the premises where sold, nor to prevent the sale, for consumption on the premises where sold, of containing not to exceed five percent of alcohol , under issued in accordance with the provisions of this chapter.
