Petition to extend return date, when and where filed

If someone gets a legal demand to hand over information during an investigation, they can ask a court to give them more time, change the demand, or cancel it. They have to do this before the deadline shown on the demand, or within 20 days of getting it — whichever comes first. They file that request at a local circuit court.

407.070. to extend , when and where filed. — At any time before the return date specified in a issued under section 407.040, or within twenty days after the civil investigative demand has been , whichever period is shorter, a petition to extend the return date for, or to or the civil investigative demand, stating , may be filed in the of the county where the parties reside or in the circuit court of Cole County.
