Definitions
These are the definitions for words used in Missouri's telephone solicitation laws. A 'caller identification service' is a phone feature that shows who is calling. A 'residential subscriber' is someone who has home, wireless, or similar phone service mostly for personal or family use, including people who live with them. 'Telephone solicitation' means calls, faxes, or text messages trying to get someone to buy, rent, or invest in something — but there are exceptions. It does NOT count as telephone solicitation if the person already gave permission, if there is a current or recent business or personal relationship (within 180 days), if it is a nonprofit charity calling to raise money, if a government-regulated business is required to keep a no-call list, or if the caller is a licensed professional trying to set an appointment related to their licensed work.
407.1095. Definitions. — As used in sections 407.1095 to 407.1110, the following words and phrases mean:
(1) "", a type of telephone which s telephone to see the telephone number of incoming telephone calls;
(2) "", a person who, for primarily personal and familial use, has subscribed to residential telephone service, wireless service or similar service, or the other persons living or residing with such person;
(3) "", any voice, , short messaging service (SMS), or multimedia messaging service (MMS), for the purpose of encouraging the purchase or rental of, or investment in, property, goods or services, but does not include communications:
(a) To any residential subscriber with that 's ;
(b) By or on behalf of any person or with whom a residential subscriber has had a business contact within the past one hundred eighty days or a current business or personal relationship;
(c) By or on behalf of an entity organized Chapter 501 (c)(3) of the United States Internal Revenue Code, while such entity is engaged in -raising to support the for which the entity was established provided that a member of such makes the voice communication;
(d) By or on behalf of any entity over which a federal agency has to the extent that:
a. Subject to such , the entity is required to maintain a , permit or to sell or provide the being offered through ; and
b. The entity is required by law or to develop and maintain a ;
(e) By a responding to a , or working from his or her primary residence, or a person licensed by the state of Missouri to carry out a trade, or profession who is setting or attempting to set an appointment for actions relating to that licensed trade, occupation or profession within the state or counties to the state.
