Unsolicited electronic mail without either return email address or toll-free number prohibited

Businesses in Missouri cannot send people unsolicited emails advertising things for sale, rent, or lease unless the email includes a toll-free phone number or a working return email address so the person can ask to stop getting those emails. It is also against the law to help someone send these kinds of spam emails if a person knows the sender is breaking the rules. Phone and internet companies that simply carry the emails through their networks are not considered to be helping in a way that breaks this law.

407.1123. without either email address or -free number prohibited — 1. No person or conducting business in this state shall electronically mail (email) or cause to be emailed documents consisting of advertising for the , sale, rental, gift offer or other of any , goods, s or extensions of without a or valid sender-operated return email address that the recipient of the documents may call or email to notify the sender not to email any further unsolicited documents.

2. It is an to assist in the transmission of an message when the person providing the assistance knows, or , that the of the is engaged, or intends to engage, in any act or practice that violates sections 407.1120 to 407.1132.

3. As used in this section, the phrase "assist or " does not include or refer to the transmission of any commercial electronic mail message by a or to the extent that the telecommunications utility or internet service provider merely carries such transmission over its network.
