If someone gets an illegal commercial email (spam), they can receive $500 or their actual losses, whichever is more. If an online service is harmed by illegal spam, it can receive $1,000 or its actual losses, whichever is more.
407.1129. . — 1. Damages to the recipient of a sent in violation of sections 407.1120 to 407.1132 are five hundred dollars, or , whichever is greater.
2. Damages to an resulting from a violation of sections 407.1120 to 407.1132 are one thousand dollars, or actual damages, whichever is greater.
