Repurchase required, when
When a manufacturer ends their deal with a boat dealer, the manufacturer has to buy back certain things from the dealer within 30 days. This includes new, unsold boats from the current and prior model year, as well as parts and accessories the dealer bought from the manufacturer. The prices paid back to the dealer depend on what is being returned, but are based on what the dealer originally paid.
407.1368. required, when. — If the boat, marine, , or is terminated, or not renewed by the , the manufacturer shall, at the of the boat, marine, vessel, or personal watercraft , within thirty days of , repurchase:
(1) (a) All new, untitled current model year , acquired from the manufacturer, which has not been used (except for demonstration purposes), altered or damaged to the extent that such damage must be disclosed to the section 407.1343, at one hundred percent of the , less transportation, applicable , and discounts to the dealer;
(b) All new, untitled inventory of the prior model year, acquired from the manufacturer, provided the prior model year vessels have not been altered, used (except for demonstration purposes) or damaged to the extent that such damage must be disclosed to the consumer pursuant to section 407.1343, and were or paid within one hundred twenty days prior to the of the termination, , or ;
(c) Any other existing inventory provided the boat, marine, vessel, or personal watercraft dealer and the manufacturer have agreed on a value for such inventory.
(2) All current and undamaged manufacturer's accessories and sold to the dealer for , if accompanied by the original , at one hundred percent of the original net price paid to the manufacturer minus a ten percent freight and *.
