Replacement of farm machinery or refund of purchase price, when

If a farm machine has a problem that seriously affects how it works or its value, and the maker cannot fix it after a fair number of tries, the maker has to give the buyer a choice. The buyer can get a similar new machine, or get their money back — including extra costs they paid — minus a small amount for however long they used the machine. If someone else has a loan on the machine, that lender gets part of the refund too.

407.588. Replacement of farm machinery or refund of purchase price, when — allowance deducted for 's use — refund made to whom. — 1. If the , or its , cannot the new farm machinery to any applicable by repairing or correcting any or condition which substantially impairs the use or of the new farm machinery to the consumer after a reasonable number of attempts, the manufacturer shall give the consumer the option of having the manufacturer either replace the new farm machinery with a new farm machinery acceptable to the consumer, or take of the machine from the consumer and refund to the consumer the full purchase price, including all reasonably incurred , less a reasonable allowance for the consumer's use of the machine. The subtraction of a shall apply when either a replacement or refund of the new farm machinery occurs.

2. Refunds shall be made to the consumer and , if any, as their interests may appear.
