Unlawful practices
A buyers club is a business that helps members buy goods at a discount. This law says buyers clubs cannot trick or mislead people who want to join. Before someone signs up, the club must put in writing: whether items can only be ordered from catalogs with no samples to look at, the club's rules on returns, refunds, and cancellations, all extra costs like shipping and handling fees, a list of what kinds of products are available, and how much money is needed upfront. The club also cannot lie about being connected to other clubs, promise benefits that are not actually available, fail to deliver promised gifts, claim to always have the lowest prices if that is not true, or say a certain product or supplier is available when it is not.
407.677. practices. — 1. It shall be a violation of for any to fail to disclose to a in writing, prior to the sale of any contract for :
(1) That goods or s can only be bought through catalogs with no opportunity to inspect samples;
(2) The buyers club's policies regarding warranties or guarantees on goods ordered, of ordered goods by buyers, procedures for of orders by the buyer, and refunds of for the cancellation of orders;
(3) Any , such as estimated freight costs, handling fees, life or insurance, s' and buyers clubs' markup, and other costs to the purchase of goods through the buyers club and which are to be paid by the buyer;

If the list includes savings based on price comparisons, the savings claims must be based on price comparisons with retailers doing business in the trade who sell or offer for sale the same or goods and at the prices the goods are sold or offered for sale by such retailers;
(5) The percentage of the purchase price required as a on merchandise orders of any nature. This shall apply in all cases where are offered, regardless of whether such promised rebates are the 's ability to enroll the referred persons into the buyers club.
2. In addition, it shall be a violation of section 407.020 for a to:
(1) Represent that it is with any other buyers club organization or showroom unless an in fact exists and unless the buyer would be legally entitled to services from the allegedly affiliated organization as a result of being a buyer of the buyers club. (2) Represent that the prospective buyer will be entitled to a particular unless that benefit is currently available from the buyers club on a regular basis;
(3) Offer any gifts or of any nature to a prospective buyer as a for said persons to attend a buyers club sales presentation or to sign a membership application or a contract for discount buying services where the club fails to honor or the gift or consideration in accordance with the term of its promise;
(4) Represent or suggest in any manner that it offers its buyers the lowest prices, excluding freight and service charges, available on all categories of merchandise handled by the club, unless such is true;
(5) Represent that merchandise is available to its buyer from any particular supplier unless such is true at the time the representation is made. Reference to unavailable suppliers or manufacturers may be made only for purposes of allowing prospective buyers to compare merchandise costs against those manufacturers which are available through the club. No buyers club may represent to a prospective buyer, unless it is true, that the club can purchase any item of merchandise at supplier's cost if the buyer provides the club with the necessary model number for the item.
