Costs, fees, and expenses
In a court case about child custody across states, the side that wins can get their costs paid by the other side. This includes things like lawyer fees, travel costs, and child care costs during the case. The only way out of paying is if the losing side can show it would clearly be unfair to make them pay. Also, a state government generally cannot be made to pay these costs.
452.890. Costs, fees, and expenses. — 1. The court shall the , including a state, necessary and reasonable expenses incurred by or on behalf of the , including costs, communication expenses, , , expenses for witnesses, travel expenses and child care during the course of the proceedings, unless the party from whom fees or expenses are sought establishes that the award would be clearly inappropriate.
2. The court shall not fees, costs or expenses against a state except as otherwise provided by law other than sections 452.700 to 452.930.
