Initiation by governmental entity of support proceeding under convention

This law is about how Missouri handles child or family support cases that involve other countries, under an international agreement called 'the Convention.' The state's family support division sends and receives paperwork and helps start these cases in court. Someone who is owed support (an obligee) can ask the court to create, recognize, or enforce a support order from another country. Someone who owes support (an obligor) can ask the court to recognize an order that pauses or changes an existing support order. Missouri courts cannot make anyone pay a deposit or post a bond just to cover court costs in these international support cases.

454.1689. Initiation by of under . — (a) In a support proceeding under this Article, sections 454.1680 to 454.1716, the of this state shall:

(1) transmit and receive s; and

(b) The following support proceedings are available to an under :

(c) The following support proceedings are available under the Convention to an against which there is an existing support order:

(1) recognition of an order suspending or limiting enforcement of an existing support order of a tribunal of this state;

(2) modification of a support order of a tribunal of this state; and

(3) modification of a support order of a tribunal of another state or a foreign country.

(d) A tribunal of this state may not require , , or , however described, to guarantee the payment of costs and expenses in proceedings under the Convention.
