Duties of the family support division
The family support division checks if people getting certain government benefits are helping to find the other parent of their child and set up child support. People getting this help have to share information, go to meetings or hearings, and take a DNA test if ordered. They can be asked to sign a paper saying who the father is, but they cannot be forced to sign it. The division has to tell everyone involved about any decisions it makes.
454.408. Duties of the . — The family support division:
(1) Shall determine whether a person who has applied for or is receiving assistance from a program funded Part A or Part E of of the Social Act, of the Social Security Act or the Food Stamp Act is cooperating with the in establishing the of, or in establishing, modifying or enforcing a for any child of such person by providing the division with the name of the or any other the division may require. The division may, by , excuse with the of this on a case-by-case basis for or other exceptions as the division may deem to be in the ;
(2) Shall require as a condition of cooperation that such person supply additional information necessary by the division and appear at any interviews, hearings or legal proceedings;
(3) Shall require as a condition of cooperation that such person and such person's child submit to pursuant to a judicial or ;
(4) May request that such person a , after notice of the rights and consequences of such an , but may not require such person to sign an acknowledgment or otherwise the right to a genetic test as a condition of cooperation and eligibility for assistance from a state program funded pursuant to Part A or Part E of Title IV of the Social Security Act, Title XIX of the Social Security Act or the Food Stamp Act; and
(5) Shall promptly notify such person, the family support division, or the of every made pursuant to this section, including a determination that such person is not and the basis for such determination.
