Employer or union to transfer order to group health plan

When a boss or union gets a court or government order to add a child to a health insurance plan, they have to send that order to the right health insurance plan within 20 work days. Then the person who runs the health plan has 40 work days to let the agency know if the child can be covered and how to make that happen, and to send any forms needed to get the child covered.

454.615. Employer or union to to — duties of . — 1. Upon receipt of a court or , or notice, for , the employer or union shall transfer the order or notice to the group health plan providing the health plan coverage for which the child is eligible, excluding any to withhold for health care coverage directing the employer or union to withhold any to the plan, within twenty business days after the date of the order or notice.

2. Within forty business days after the date of the order or notice, the plan administrator shall:

(1) Notify the whether coverage of the child is available under the terms of the plan and, if so, whether such child is covered under the plan and either the of such coverage or, if necessary, any steps to be taken by the or issuing agency to such coverage; and

(2) Provide to the custodial parent or issuing agency a description of the coverage available and any forms or documents necessary to effectuate such coverage.
