Payment of benefit due, discharge from liability
When a custodial parent files a health insurance claim for their child, the insurance company pays the money directly to the custodial parent — as long as the provider hasn't already been paid and the noncustodial parent hasn't paid out of pocket. Once the insurance company makes that payment, it is off the hook for that claim.
454.624. Payment of due, from . — In the case of any submitted by the for care provided to a child who is as an an or notice of , the or shall, in the absence of an to the with respect to such claim or of payment by the , pay to the custodial parent any benefit due. The health benefit plan administrator or insurer shall be fully from any and all liability on the claim to the extent of such payments to the custodial parent.
