When a surviving business partner does not turn in required paperwork — like an inventory of the business, a list of debts, or an appraisal — the court can order that person to show up and explain why. The partner gets at least 10 days notice before the court date. If the partner keeps refusing to follow the court's orders, the court can put that person in jail until they comply, and can also bring in someone else to manage the business and make the partner pay the costs.
473.230. of partner. — If the fails or refuses to file the , list of , or or it appears proper to the surviving partner to account to the or to file a , the court shall order a citation to requiring the surviving partner to appear and why he has not filed an inventory, list of liabilities, or appraisal or why he should not or file a bond. The citation shall be not less than ten days before the day therein and shall be served and returned in the manner provided for in . If the surviving partner neglects or refuses to file an inventory, list of liabilities, or appraisal or fails to account to the court or to file a bond, after he has been directed to do so, the court may commit him to jail until he complies with the order of the court. Where the surviving partner fails to file a bond after being ordered to do so by the court, the court may also appoint a of the with like powers and duties of receivers in , and order the and expenses of the proceedings to be paid out of the partnership estate or out of the of , or by the surviving partner personally or partly by each of the parties.
