Interest of purchaser for value from, or lender to, distributee of property protected

When someone gets property from an estate and then sells it or uses it as collateral for a loan, the buyer or lender is protected. Even if something went wrong with how the property was handed out from the estate, the buyer or lender still gets clean title and does not owe anything to the estate or its heirs. The buyer or lender does not have to look into whether the person who handed out the property did everything correctly.

Interest of purchaser for value from, or lender to, of property protected. — If property or a therein is acquired for value by a purchaser from or lender to a distributee who has received an from the , or is so acquired by a purchaser from or lender to a from such distributee, the purchaser or lender takes free of rights of any in the and incurs no to the estate, or to any interested person, whether or not the was proper or supported by or the of the independent personal representative was terminated before of the or . This section protects a purchaser from or lender to a distributee who, as independent personal representative, has a to himself, as well as a purchaser from or lender to any other distributee or his transferee. To be protected under this , a purchaser or lender need not inquire whether an independent personal representative acted properly in making the , even if the independent personal representative and the distributee are the same person, or whether the authority of the independent personal representative had terminated before the distribution.
