Persons adjudged incompetent prior to September 28, 1983
If a court declared someone incompetent before September 28, 1983, that person is treated as fully incapacitated and disabled under current law. A court can later review the situation and change that status if the person does not meet the current definition of fully incapacitated and disabled. People who were appointed as guardians before that date are treated as guardians or conservators under current definitions. Guardians and conservators had one year after August 28, 2018, to catch up with any new reporting rules.
