Filing of notice of pendency of action in other court against conservator, effect
If someone has a lawsuit going on in another court against a conservator or the person they protect, filing a notice of that lawsuit (or a copy of the court's decision) in the probate court counts as officially filing a claim there. Also, a certain other law about estates does not apply when the protected person is disabled. This rule applies to disabled people whose disability was officially decided by a court on or after August 28, 1993.
475.210. of notice of of in other court against , effect — , of law. — 1. The filing in the of a notice of the pendency in some other court or of an action, suit or against the or the conservator, or of a copy of the of such other court or division in such action, suit or proceeding shall be a filing of the asserted in such action, suit or proceeding.
2. Section 473.360 shall not apply to the estates of disabled persons.
3. This section shall apply to the estates of disabled persons whose is on or after August 28, 1993.
