Advance payment predicated on possible tort liability not admissible in evidence

Random law
In plain English

If someone pays money early to help an injured person or their family — before any court case is decided — that early payment cannot be used in court to prove the person who paid was at fault. If a case goes to trial, the jury is not told about those early payments. Whatever was paid early gets subtracted from any final settlement or court award. If a court later decides the person who paid was not liable for enough money to cover what they already paid, they cannot sue to get that money back. The clock for filing a lawsuit starts on the date of the last early payment made.
