On death of person under disability, cause of action survives
If a person had the right to sue but died before the deadline to file their lawsuit, their executor or administrator (the person handling the deceased's estate) gets extra time to file. They can file the lawsuit within one year after the person's death, even if the normal deadline has already passed.
516.180. On death of person , . — If any person so entitled to sue, die before the expiration of the time herein limited for the of such suit, if such cause of action shall to his , his or may, after the expiration of such time and within one year after such death, commence such , but not after that period.
