Action for damages to property to survive regardless of death of either party

If someone damages another person's property, the injured person can sue them. If the injured person dies, someone appointed to manage their estate can still file the lawsuit. If the person who caused the damage dies, the lawsuit can still be filed against their estate too. These cases are handled the same way as cases over broken contracts.

537.010. for to property to regardless of death of either . — Actions for wrongs done to property or interests therein may be brought against the by the person whose property or interest therein is injured. If the person whose property or interest therein is injured is dead, the action and may be brought against the wrongdoer by the person appointed as for the of the person. If the wrongdoer is dead, the action also survives and may be brought and maintained in the manner set forth in section 537.021. Such actions shall be brought and maintained in the same manner and with like effect in all respects as actions founded upon contracts.
