Political subdivisions to defend tort actions against firemen involving use of motor vehicles
If a paid firefighter gets sued because someone was hurt or property was damaged while the firefighter was driving a fire truck or other fire department vehicle on the job, the city, county, or fire district that employs them has to provide a lawyer and handle the case for that firefighter. However, if the firefighter loses the lawsuit, the city or fire district does not have to pay the money owed — that stays on the firefighter personally.
537.165. to defend s against firemen involving use of motor vehicles — extent of . — Every county, city, town, village, or other of the state having a full time salaried fire shall defend, in the name and on behalf of the members of its fire department in any action brought against a member involving for death or injury to persons or property arising out of their operation of motor vehicles of the fire department in the performance of their duties. Such shall be conducted by the regular legal staff of the county, city, town, village, fire district or other political subdivision involved. No , or liability for , obtained against any such member in any such action shall be a liability of the county, city, town, village, fire district or other political subdivision defending such action.
