Unlawful possession of drug paraphernalia

It is against the law to own or use drug paraphernalia — tools made for handling or using drugs. A first offense is a small misdemeanor, but if a person has a prior drug conviction, it becomes a bigger misdemeanor. A person commits the of unlawful possession of drug paraphernalia if he or she uses, or possesses with intent to use, drug paraphernalia to plant, , cultivate, grow, harvest, , compound, convert, produce, , prepare, test, analyze, pack, repack, store, contain, conceal, inject, ingest, inhale, or otherwise introduce into the human body, a or an in violation of this chapter or chapter 195.

2. The offense of unlawful possession of drug paraphernalia is a , unless the person has previously been of any offense of the laws of this state related to or of the laws of another related to controlled substances, in which case the violation of this section is a . shall be in the same manner as required by section 558.021.
