Distribution of prescription medication on school property

This law is about giving out prescription medicine at school. If someone is under 21 years old and gives a prescription medicine to another person at a public or private K-12 school or on a school bus, and that other person does not have their own prescription for that medicine, it is a crime. This does not count as a crime if a school staff member gave permission to hand out the medicine, or if it is given by emergency workers during an emergency. Also, this law does not cover medicines that are controlled substances — those are handled under a different law. The first time someone breaks this law, it is a class B misdemeanor. A second or later offense is a class A misdemeanor.

579.150. Distribution of on school property — exceptions — . — 1. A person commits the of distribution of prescription medication on school property if he or she is less than twenty-one years of age and upon the comprising a public or private elementary or secondary school or school bus a prescription medication to any individual who does not have a for such medication. For purposes of this section, prescription medication shall not include medication containing a , as defined in section 195.010.

2. The of this section shall not apply to any person to a prescription medication by any school personnel who are responsible for storing, maintaining, or any prescription medication under chapter 338. This section shall not limit the use of any prescription medication by emergency personnel during an emergency situation.

3. The offense of distribution of prescription medication on school property is a for a first offense and a for any second or subsequent offense.
