Destruction of arrest records

When a court orders an arrest record expunged, the record gets destroyed. If destroying it is not possible, the information gets blacked out instead. The record also gets removed from all Missouri computer systems. Missouri then asks the FBI to remove it from their files too. If someone disagrees with the court's decision about expunging a record, they can appeal it like any other civil court case.

610.124. Destruction of s — removal from all electronic files — FBI requested to to , procedure. — 1. All records ordered to be section 610.123 shall be destroyed, except as provided in this section. If destruction of the record is not feasible because of the permanent nature of the record books, such record entries shall be blacked out. Entries of a record ordered expunged pursuant to section 610.123 shall be from all electronic files maintained with the state of Missouri. The shall request the Federal Bureau of Investigation expunge the records from its files.
