Physical or mental deficiency of employee, wage rate, determined by director, how

If someone cannot work as fast or as well as others because of a physical or mental disability, the director can set a lower minimum wage for that person. But if that person keeps up with the same work level as everyone else, they must be paid the regular minimum wage. Before making this rule, the director holds a public meeting where anyone can speak, and the affected workers or their guardians must be told about the meeting ahead of time.

290.515. Physical or mental of employee, wage rate, determined by , how. — After a public at which any person may be heard, the director shall provide by for the in any of individuals whose earning capacity is impaired by physical or mental deficiency at wages lower than the wage rate applicable under sections 290.500 to 290.530. The individuals shall be employed as the director finds to prevent of opportunities for employment, to avoid , and to the wage rate applicable under sections 290.500 to 290.530, except that no individual who maintains a production level within the limits required of other employees shall be paid less than the wage rate applicable under sections 290.500 to 290.530.
