Joinder of a party

If a court finds out that someone who is not part of a custody case has the child or claims rights to see the child, the court can make that person join the case. That person must be told the case is happening and that they are now part of it. If that person lives in another state, they still get officially notified by the rules that cover out-of-state people.

452.782. of a . — If the court learns from furnished by the parties under section 452.800 or from other sources that a person not a party to the has of the child or to have or with respect to the child, it may that person to be as a party and to be duly notified of the of the and of his or her joinder as a party.
