Application of act to resident of foreign country and foreign support proceeding
Missouri courts use specific sections of state law when dealing with child or spousal support cases that involve another country. This applies when there is a support order from another country, a court from another country is involved, or one of the people in the case lives in another country. Special rules also apply for cases that fall under an international agreement called the Convention, and those special rules take priority if there is a conflict.
454.1512. of act to resident of foreign country and foreign . — (a) A of this state shall apply Articles 1 through 6, sections 454.1500 to 454.1677, and, as applicable, Article 7, sections 454.1680 to 454.1716, to a support proceeding involving:
(1) a ;
(2) a ; or
(3) an , , or child residing in a foreign country.
(b) A tribunal of this state that is requested to recognize and a on the basis of may apply the and of Articles 1 through 6, sections 454.1500 to 454.1677.
(c) Article 7, sections 454.1680 to 454.1716, apply only to a support proceeding under . In such a , if a of Article 7, sections 454.1680 to 454.1716, is inconsistent with Articles 1 through 6, sections 454.1500 to 454.1677, Article 7, sections 454.1680 to 454.1716, controls.
