Procedure to register order for enforcement

If someone has a child support order from another state or country, they can send it to the right court in Missouri to get it registered and enforced here. To do that, they send a letter asking for registration, two copies of the order (one certified), a sworn statement showing any unpaid amounts, and information about the person who owes support — like their address, employer, and any property in Missouri. If more than one support order exists, the person registering must send copies of all of them and identify which one is the main controlling order.

454.1635. Procedure to for . — (a) Except as otherwise provided in section 454.1695, a or of another state or a may be in this state by sending the following records to the in this state:

(1) a letter of transmittal to the tribunal requesting and enforcement;

(2) two copies, including one , of the order to be registered, including any of the order;

(3) a by the person requesting registration or a by the of the records showing the amount of any ;

(4) the name of the and, if known:

(A) the obligor's address and Social number;

(B) the name and address of the obligor's employer and any other source of income of the obligor; and

(C) a description and the location of property of the obligor in this state not ; and

(5) except as otherwise provided in section 454.1581, the name and address of the and, if applicable, the person to whom support payments are to be .

(b) On receipt of a request for registration, the shall cause the order to be filed as an order of a tribunal of another state or a foreign support order, together with one copy of the documents and , regardless of their form.

(c) A or seeking a that must be under other law of this state may be filed at the same time as the request for registration or later. The must specify the grounds for the remedy sought.

(d) If two or more orders are in effect, the person requesting registration shall:

(1) furnish to the tribunal a copy of every support order asserted to be in effect in addition to the documents specified in this section;

(2) specify the order alleged to be the , if any; and

(3) specify the amount of , if any.

(e) A request for a of which is the controlling order may be filed separately or with a request for registration and enforcement or for registration and modification. The person requesting registration shall give notice of the request to each whose rights may be affected by the determination.
