Direct request

A person can ask a court directly — without going through the family support division — to set up, change, or enforce a child support order, or to prove who a child's parent is. If the request is to enforce a support order from another country, that person does not have to pay a security deposit for court costs, and if they got free legal help in the other country, they may get the same free legal help here. The family support division does not help people who file this kind of direct request.

454.1692. . — (a) A may file a direct request seeking or of a or of a child. In the , the law of this state applies.

(b) A petitioner may file a direct request seeking of a support order or support agreement. In the proceeding, sections 454.1695 through 454.1716 apply.

(c) In a direct request for recognition and enforcement of a or :

(1) a , , or is not required to guarantee the payment of costs and expenses; and

(2) an or that in the issuing country has ted from free legal assistance is entitled to benefit, at least to the same extent, from any free legal assistance provided for by the law of this state under the same circumstances.

(d) A petitioner a direct request is not entitled to assistance from the .

(e) This Article, sections 454.1680 to 454.1716, does not prevent the of laws of this state that provide simplified, more rules regarding a direct request for recognition and enforcement of a or foreign support agreement.
