Compensation of independent personal representative and attorney

When someone is put in charge of handling a dead person's estate on their own (called an independent personal representative), they get paid a reasonable amount for their work. The law sets a minimum amount they can be paid based on a set payment schedule. They can choose to give up some or all of their pay, and they can write that down and file it with the court. The lawyer helping them also gets reasonable pay. Neither the person in charge nor the lawyer can get paid more than the minimum set by the schedule unless a court says it is okay.

473.823. of and attorney. — 1. An independent personal representative is entitled to reasonable compensation for his services. The prescribed in section 473.153 shall be considered a minimum fee for services rendered. An independent personal representative may his right to all or any part of the compensation. A written of fee may be filed with the court.

2. If the provides for compensation of the independent personal representative, and there is no contract with the regarding compensation, he may renounce the before qualifying only if he also renounces the right to under 1 of section 473.780. In the event of such renunciation, the shall be unless is under subsection 2 or 3 of section 473.780.

3. An independent personal representative's attorney shall be entitled to reasonable compensation for his services, but in no event shall the compensation of the independent personal representative or his attorney be in excess of the minimum prescribed by section 473.153, without by the court. The contained in such section shall be of the reasonableness of the fees charged.
