Judgment of incapacity or disability set aside, when

A court can cancel a ruling about whether someone is mentally capable or disabled, but only within 60 days of that ruling and only if there is a good reason. If a new hearing is held and the result is the same as before, the original ruling stays in place.

475.077. of or , when. — The court may, if just cause appears, at any time within sixty days after a judgment as to the or disability of any person has been entered, set aside the judgment and a new ; but if the result of the new hearing is the same as the result of the first, then the judgment shall not be set aside.
