A court can appoint a guardian for someone if there is strong proof that the person cannot care for themselves and no simpler option would work. A court can appoint a conservator to manage money or property for a minor or a disabled person if simpler options would not meet their needs. Before a public administrator can be appointed to any of these roles, they must be notified first and given a chance to take part in the hearing.
475.079. appointing or . — 1. If it appears to the court or if it is found by the jury or the court upon by that the person for whom a guardian is sought is as defined in this law and that the 's identified needs cannot be met by a , the court may appoint a .
2. If it is found that the person for whom a is sought is a or is as defined in section 475.010 by a other than or in addition to and that the respondent's identified needs cannot be met by a less restrictive alternative, the court may appoint a conservator of the estate, who may be the same person appointed guardian of the person.
3. The court shall not appoint the to serve as guardian, , conservator, , emergency guardian, emergency conservator, , or unless notice is first given to the public administrator as provided in 3 of section 475.075 and the public administrator has an opportunity to participate in any on such matter, including the right to witnesses and to offer witnesses and evidence.
