When someone files a court request saying a person may not be able to care for themselves, and that person seems likely to seriously hurt themselves or others because of a mental disorder or intellectual/developmental disability, a court can have that person temporarily held in a facility. This holds them until a hearing can take place. The rules for how this happens follow other Missouri laws about detaining people with mental disorders before a hearing.
475.355. Temporary emergency . — 1. If, upon the of a for the it appears that the , by reason of a or or , presents a to the respondent or others, the respondent may be in accordance with the of chapter 632 if suffering from a mental disorder, or chapter 633 if the respondent has an intellectual or developmental disability, pending a on the petition for .
2. As used in this section, the terms "mental disorder" and "intellectual disability" or "developmental disability" shall be as defined in chapter 630 and the term "likelihood of serious physical harm to the respondent or others" shall be as the term "likelihood of serious harm" is defined in chapter 632.
3. The procedure for obtaining an of temporary emergency detention shall be as prescribed by chapter 632, relating to of mentally disordered persons.
