If someone brings more than three witnesses to prove one single fact, or brings witnesses but never actually has them testify, that person has to pay the extra costs those witnesses caused. The only exception is if the other side admitted to the fact during the trial, making those witnesses unnecessary.
491.370. Cost of es paid by whom. — If either more than three witnesses to prove any one fact, or shall subpoena any person or persons and not examine them as witnesses on the trial, he shall pay the by such surplus or unnecessary witness or witnesses, unless the of such unexamined witnesses shall be rendered unnecessary by of the opposite party on the trial.
