No tolling by filing of administrative actions, certain suits
When someone files a complaint with a government agency, that does not pause or stop the clock on the deadline to file a lawsuit. The lawsuit still has to be filed within the time limit set by the law, no matter what is happening with the agency complaint. Also, if a government agency gives permission to file a lawsuit, that permission cannot be used as proof that someone actually broke the law.
516.103. No by of , certain suits. — The time for of any suit provided for in sections 516.380, 516.390 and 516.400, shall not be by the filing or of any and no such suit may be brought or maintained unless within the time prescribed by said sections. An authorizing the commencement of any such suit shall not be considered as evidence of the violations alleged in any such suit.
