Action against mining operator for wrongful death of employee
If a mine worker dies because of the mine owner's negligence, the worker's family can sue for money. The widow has six months after the death to file a lawsuit. If she does not, the kids under 18 have up to twelve months after the death to file. The most money the family can win is ten thousand dollars.
537.230. against mining for of employee — amount — . — Whenever any shall to any of any person, company or operating a mine or mines in this state under sections 537.180 to 537.210, and death shall ensue to such agent or servant by reason of the provided for in said sections, the cause of action shall in favor of the and of the ; provided, that action therefor shall be brought by the widow within six months after such death, and if she shall fail to bring such action then within twelve months after such death by such minor children; and provided further, that recovery in case of such death shall not exceed the sum of ten thousand dollars.
