A judge can put someone on probation instead of sending them to jail or prison. The judge has to believe two things: first, that keeping the person locked up is not needed to keep the public safe; and second, that the person would benefit from help or guidance that probation can provide.
559.012. Eligible for , when. — The court may place a person on probation for a specific period upon of any or upon if, having regard to the nature and circumstances of the offense and to the history and character of the , the court is of the opinion that:
(1) of the defendant is not necessary for the protection of the public; and
