Female may recover wages, when

If a female worker is paid less than a male worker for the same job just because she is a woman, she can take the employer to court and get the missing wages plus court costs. Even if she agreed to work for less pay, she can still sue. The person filing the lawsuit has to prove that the lower pay was because of her sex, not some other reason.

Word-for-word law

290.440. Female may recover wages, when — . — 1. Any employer who violates section 290.410 is to the female employee affected in the amount of the wages of which the female employee is deprived by reason of the violation.

2. Any female employee receiving less than the wage to which she is entitled under sections 290.400 to 290.450 may recover in a the balance of the wages, together with the costs of suit, any agreement to work for a lesser wage.

3. The burden of proof shall be upon the person bringing the to establish that the is based upon the factor of sex and not upon other differences or factors.
