Restrictions on sales of individual packs of cigarettes

A store cannot sell single packs of cigarettes or smokeless tobacco unless one of two things is true: the pack is sold from a vending machine, or the pack is kept behind the checkout counter where the sales clerk can clearly see it.

407.928. on sales of individual packs of cigarettes. — No person or shall sell individual packs of cigarettes or products unless such packs satisfy one of the following conditions prior to the time of sale:

(1) It is sold through a ; or

(2) It is displayed behind the check-out counter or it is within the of the sales or store attendant from the checkout counter.
